Regulations for using the kidskitchen.pl website

§ 1 Definitions

The Kids' Kitchen website available at https://kidskitchen.pl is run by KIDS CRAFTS Robert Freyre, ul. Żwirki i Wigury 19/7a, 40-063 Katowice, Tax Identification Number 6342749796.

By concepts (written in small or capital letters), the terms used in this regulation are:

Child - participant of the classes - an underage natural person who takes or will take part in classes on the basis of the Application made by the Client and the Participation Agreement concluded by him.

Form of participation - a form of declaration of the child's participation in selected classes, available online at the site kidskitchen.pl, presented at the Application with the Customer's statements, which will be included in the Participation Agreement.

Client - a natural person who has registered the Child for Classes through the Participation Form available at kidskitchen.pl and has concluded the child participation agreement in the Classes with the Organizer, the legal guardian of the Child.

Organizer – the entity organizing Classes, or KIDS CRAFTS Robert Freyre, ul. Żwirki i Wigury 19/7a, 40-063 Katowice, Tax Identification Number 6342749796, owner of the 'Kids' Kitchen' Cooking Academy for Kids’ brand.

Regulations – the document defining the principles, rights and obligations of using kidskitchen.pl website by Users as well as the rights and obligations of the Organizer towards Customers.

Rules of participation - regulations of the classes being run, prepared by the Organizer and being an attachment to the participation agreement.

GDPR - Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC.

Service - a public internet portal operating under the domain of kidskitchen.pl, run by the Organizer and allowing the presentation of the Organizer's Activities, enabling the Application to be made, supporting the conclusion of the Participation Agreement and presenting details of the Organizer's activities and offers.

Contract of participation - it is an agreement on the participation of the Child in the Classes, concluded between the Organizer and the Client, defining the rules for the child's participation in the classes.

User - a natural person, legal entity or organizational unit without legal personality using the Kidskitchen.pl website.

Classes - periodic or one-off classes, which include culinary workshops, holiday cooking academies, birthday parties, and other forms of activities for children run by the Organizer.

Reporting - a service consisting in online booking the Child's participation in the Class by the Customer, which specifies the manner of concluding the Participation Agreement.

§ 2 General provisions

  1. The use of the Website is free of charge and available to all Users.

  2. Each User using the Website is obliged to comply with the provisions of the Regulations.

  3. The regulations have been prepared in accordance with art. 8 sec. 1 point 1 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002 No. 144 item 1204), in accordance with art. 12 para. 1 of the Act of 30 May 2014 on consumer rights in order to fulfill the information obligations of the entrepreneur in contracts concluded away from the business premises or at a distance and in accordance with the GDPR.

§ 3 Types and scope of services provided

  1. The Organizer provides the following electronic services via the Website:

    1. presentation of the offer and in particular the description and schedule of the classes;

    2. allowing to register the participation in classes through the appropriate form;

    3.  enabling online payments for the Child's participation in the classes;

    4.  enabling sending messages via the contact form available on the Website.

  1. By completing the online form at kidskitchen.pl, the User agrees to receive information on the activities in Kids' Kitchen provided in the e-mail form. The organizer sends marketing information about new classes, subject to the consent of the client.

  2. The organizer makes every effort to ensure the highest quality of services and provides support in the process of concluding the participation agreement.

§ 4 Registration of participation in the Classes and conclusion of the Agreement

  1. The Customer's registration of participation of the Child in selected Activities does not require registration on the Website.

  2. Clients may submit Applications for participation using the Website at any time, 24 hours a day, 7 days a week.

  3. Applications can only be made by an adult. For this purpose, an adult:

    1. completes the Application Form, providing the data listed therein, including in particular the age and the name of the Child and their personal data: name, telephone number, e-mail address and also selects Classes, date and gives their own preferences regarding the nature of the Course;

    2. confirms reading the content of the kidskitchen.pl Regulations by checking the box;

    3.  clicks on the "Pay Online" or "Traditional Transfer" button to select the payment method. Then the customer is redirected to the summary of the Application for Participation. After choosing the "Pay online" campaign, the Customer has the option of making a payment for the participation in the classes. The application is made by sending a completed Application Form.

  4. The Participation Form may contain additional fields of consent defined by the Organizer for the Course data. These consents will be effective subject to the conclusion of the participation agreement.

  5. The Customer undertakes to provide real data in the Participation Form.

  6. The condition for making a Participation Application is to read and accept these Regulations, which the Client confirms before making the Application by checking the appropriate box in the Participation Form.

  7. Information on the total value of the order, which includes the price of participation of the Child and other selected persons in the classes and the costs of the menu and additions selected by the Client, is always provided on the Website page during filling in the Participation Form, also just before confirming and applying for participation by the Customer. These are the total costs that the customer is required to pay along with all applicable taxes and service costs.

  8. Information about the classes presented on the Website does not constitute an offer within the meaning of the provisions of the Civil Code, they constitute an invitation to conclude a sales agreement.

  9. After receiving the Application, the Organizer reserves the place and sends information to the Customer on the acceptance of the Application to the e-mail address provided when completing the Participation Form. The participation agreement in the Classes is concluded when the Organizer sends information to the Customer about the acceptance of the Application.

  10. In the case of workshops, after submitting the Application, the child is pre-registered on the list of participants and after paying the fee for the workshop, the child is entered on the list of participants.

§ 5 Payment for Classes and rules regarding Activities

  1. Payment for Classes takes place in accordance with the payment schedule and payment method selected by the Customer when making the Application for Classes.

  2. The Client has the option to pay for the Classes as a submitted Application in the following way:

    1. by bank transfer or payment to the Organizer's bank account,

    2.  online payment (online) via the TPay system.

  1. If the description of the classes or information contained in the participation form indicates that in the given case an advance payment for participation in classes is required, it should be paid in the amount specified in the description of the Courses directly to the Organizer's account no later than 3 days from the date of the Customer's submission.

  2. In the case of payments made by bank transfer or payment, the payment should be made to the bank account of KIDS CRAFTS Robert Freyre, ul. Żwirki i Wigury 19 / 7a, 40-063 Katowice, number: 47 1050 1214 1000 0092 5110 5475 in the title of a transfer or payment specifying the name and surname of the child, date and time of the Classes.

  3. The prices listed on the Website are gross prices and are expressed in Polish zlotys. The organizer reserves the right to change them at any time and without giving reasons.

§ 6 Resignation from participation in classes

  1. In the event of resignation from participation of the Child in the Classes, the Customer is obliged to immediately make a statement concerning this fact without the necessity to give a reason for the resignation.

  2. Resignation from participation in the classes submitted less than 3 days before the planned date of Classes is not possible. At the request of the client, the Organizer may, however, re-register the child for a different date of classes.

  3. The customer may resign from sending a completed and signed statement of resignation to the following address: Kids' Kitchen Academy of Cooking for Children, ul. Żwirki i Wigury 19/7a, 40-063 Katowice, and electronically by writing to: kontakt@kidskitchen.pl.

  4. In the case referred to in item 1 above, the Child is removed by the Organizer from participation in the classes.

  5. In the event of effective resignation, the Organizer shall refund the payment using the same method of payment as used by the Customer, unless the Customer indicated a different method of return in the statement of resignation, which does not involve any costs for him.

§ 7 Terms and technical requirements for the provision of services

  1. To browse subpages of the Kidskitchen.pl website, including getting to know the description of the Course, it is necessary to have a terminal device with access to the Internet and an Internet Explorer, Microsoft Edge, Google Chrome, Mozilla Firefox, Opera or Safari browser in the current version. To use some of the functionalities of the kidskitchen.pl website, including the Application for Child participation in Classrooms, an active e-mail account is also required.

  2. The use of the kidskitchen.pl website is indefinite.

  3. It is forbidden to use the Website for purposes other than those resulting from the nature and object of the Website. The Client is prohibited from providing unlawful content.

§ 8 System availability and service breaks

  1. The Organizer is not responsible for the lack of access to the Website resulting from reasons beyond the Organizer's control.

  2. The kidskitchen.pl service is designed as a 24/7/365 system, however, to ensure trouble-free operation, service intervals are required which will be performed in the hours of the least traffic on the kidskitchen.pl website.

  3. The organizer reserves the right to temporarily completely or partially exclude the Website in order to improve it, add services or carry out maintenance, without prior notice to users.

§ 9 Complaints

  1. All customer complaints are considered by the Organizer within a maximum of 14 business days and should be sent to the e-mail address kontakt@kidskitchen.pl or to the correspondence address of the Organizer, i.e.: Kids' Kitchen Academy of Cooking for Children, ul. Żwirki i Wigury 19/7a, 40-063 Katowice.

  2. The customer will be notified in writing about how the complaint will be processed.

  3. Lack of response to the complaint within the time limit referred to in point 1 above does not mean acknowledgment of the complaint.

  4. All disputes related to the services provided by the Organizer within the framework of kidskitchen.pl will be resolved by common courts.

§ 10 Protection of personal data

  1. Detailed information regarding the processing and protection of Clients' personal data is set out in the "Privacy Policy", available at https://kidskitchen.pl/polityka-prywatnosci, which is an integral part of these Regulations.

§ 11 Protection of the Organizer's rights

  1. All rights to the Website, including proprietary and non-proprietary copyrights, are vested in the Organizer.

  2. All rights to text, graphics, photos, applications, databases and other tools made available on the Website are reserved for the Organizer or other designated third parties. Use without the consent of their authors is a violation of copyright.

§ 12 Final provisions

  1. Users and Customers can access these Regulations at any time via the link provided on the Website. Regulations may be recorded, obtained and reproduced by printing it or saving it on an appropriate data carrier.

  2. The Organizer may change the provisions of the Regulations after informing the Customers by publishing a uniform text of the Regulations on the Website. Amendments to the Regulations or new contents of the Regulations come into force after 14 days from the date of placing their new content on the Website.

  3. Applications for participation made during the previous version of the Regulations will be implemented in accordance with its provisions.

  4. These regulations are subject to Polish law and subject to the jurisdiction of Polish courts.

  5. Any disputes arising between the Organizer and the Customer, who is a Consumer, will be resolved by a common court competent in accordance with the provisions of the Code of Civil Procedure.

  6. Any disputes arising between the Organizer and the Customer, who is not a Consumer within the meaning of the Act, will be settled by a common court having jurisdiction over the seat of the Organizer.
